Is Bankruptcy The Right Option?

There are many myths out there about the bankruptcy process. For example, if you file bankruptcy, you'll lose your home, your car and all of your possessions (not often true). Or, filing bankruptcy means your credit will be ruined forever (definitely not true).

The truth is that bankruptcy can be a powerful tool to deal with overwhelming debts. As a bankruptcy lawyer and member of the Hawaii Bankruptcy Bar Association, I help people in Kailua, Honolulu and across Oahu find financial freedom through bankruptcy.

What Bankruptcy Can Do

I know you likely did not enter this financial struggle willingly or deliberately. Perhaps you lost a good job or suffered a serious injury or illness. Bankruptcy is nothing to be ashamed of, and in many cases, it is the right option to help you finally achieve debt relief. Filing bankruptcy can:

  • Take care of medical debt, credit card debt and other unsecured debts
  • Stop repossession of your car
  • Halt foreclosure proceedings so you have a moment to consider your options
  • Stop harassing phone calls, letters and emails from creditors and debt collectors
  • Protect your investments, retirement accounts and other savings from being drained to pay off debt

As your bankruptcy attorney, I will walk you through the entire process from start to finish. Simple cases may only take a few months while more complex cases may require more time. My job as your advocate will be to offer candid advice and support throughout the bankruptcy process, whether you file Chapter 7 or Chapter 13 bankruptcy.

What Bankruptcy Cannot Do

Bankruptcy can help you resolve debt problems, but it has a few limitations. For example, you cannot discharge student loans, child support or alimony payments, and certain types of tax debt. The hope is that by eliminating other debts, you will have the financial freedom to once again make good on your financial obligations.

Bankruptcy also won't immediately solve bad credit. That said, by wiping away the burden of significant debt, you can start over financially. You will be surprised at how quickly your credit recovers when you do not have a mountain of overdue payments and late charges weighing it down.
