  • Pay off mortgage arrears (past-due payments)
  • Catch up on past-due car payments

Chapter 13 bankruptcy works by setting up an affordable payment plan over a period of three to five years. At the end of the plan, any debts considered unsecured, such as credit card debt or medical debt, will be discharged.

Your lawyer will work to draft a plan that works with your budget. A Chapter 13 bankruptcy plan must be approved by a trustee to ensure it is affordable.
